1. EVENT DESCRIPTION: Karen Quinn’s Wife in the Fast Lane Contest (the “Event”) is comprised of three skill-based contests (”Contest”). The Event begins at 12:01 AM (ET) on January 10, 2007 and ends at 11:59 PM (ET) on March 13, 2007 (the “Event Period”).
2. NO PURCHASE NECESSARY TO ENTER OR WIN THE CONTEST. THIS EVENT IS SPONSORED BY Karen Quinn (the “Sponsor”). Only legal residents of the US (except Puerto Rico), the District of Columbia, and Canada (except Quebec) are eligible to win this contest. The Event is governed exclusively by the laws of the United States. All federal, state and local laws and regulations apply. Void where prohibited by law.
3. ELIGIBILITY: You must be 18 years of age or older as of January 10, 2007 to enter the contest.
4. CONTEST DESCRIPTION: The Contest is comprised of three separate online skill-based contests in which participants may express themselves on the subject of juggling love, children, work, self, parents, life passions, to-do lists, etc. in any of three ways (the “Categories”):
a. Video contest 1 (“Video Contest”): Create a video up to two minutes in length that is a humorous but truthful expression of your view from “the fast lane.” Specific instructions for completing the Entry form and putting your Video on-line can be found at www.wifeinthefastlane.com.
b. Essay contest 2 (“Essay Contest”): Write a humorous, truthful essay up to 1,000 words (excluding the title) entitled: Confessions from the Fast Lane. Specific instructions for completing the Entry form and putting your Essay on-line can be found at www.wifeinthefastlane.com.
c. One-Liner contest 3 (“One-liner Contest”): Using humor and truth, finish this thought – I knew I was living in the fast lane when… Specific instructions for completing the Entry form and putting your Essay on-line can be found at www.wifeinthefastlane.com.
Entries may be submitted beginning January 10, 2007 through February 28, 2007, after which judging and voting will take place.
5. HOW TO REGISTER: Any individual wishing to participate in the Contest must first register at the Contest Site (“The Event Site”), thereby becoming an eligible participant (a “Participant”). Registration is free and available at the Event Site. As part of the registration process, Participants will be required to click where indicated to signify that they accept and agree to be bound by the terms of these Official Rules set forth at the Event Site, and the decisions of the judges and the Sponsor which are final and binding in all respects. While you may enter as many videos, essays, and one-liners (“Entry” or “Entries”) as you like, you may only vote one time.
6. THE JUDGING AND VOTING PROCESS: First, second, and third place winners for the Video Contest, Essay contest, and One-Liner Contest will be selected through a two-phase process. First (“Phase 1”), a panel of judges will read or view the Entries and decide on the top ten Entries in each Category of the Contest. Then (“Phase 2”), Participants who have registered at the site will vote for their favorite among the top ten Entries from The Video Contest, the Essay Contest, and the One-liner Contest as determined by the judges.
Judging and voting will work as follows: Between February 28, 2007 and March 2, 2007, a panel of up to ten judges will select the top ten Entries in each of the Contest (i.e., up to ten judges for the Video Contest, the Essay Contest, and the One-Liner Contest – up to thirty judges in total). The top ten finalists from each of the Categories will be posted on the site on or about March 5, 2007. As soon as the finalists are posted on the site and through 11:59 p.m. E.S.T. March 5, 2007, any Participants who has registered may vote for their favorites among the ten finalists in each Contest Category. Voting instructions can be found at www.wifeinthefastlane.com. The winning Entries will be announced no later than March 13, 2007. By submitting an Entry, Participants agree to be bound by these Official Rules and all decisions of the judges.
JUDGING criteria for PHASE 1: 1) Originality – 25 points, 2) Humor – 25 points, 3) Quality – 25 points 4) Sense of truth – 25 points.
The scale for awarding points within the criteria are:
0-5 points - poor
6-10 points - fair
11-15 points - good
16-20 points - excellent
21-25 points - extraordinary
In the event of a tie, one to three judges selected by the Sponsor will be asked to evaluate the tying Entries based on the criteria stated above until the tie is broken (these will be judges who previously evaluated Entries in a different Category). In the event that in Phase 1 the Sponsor is unable to secure ten judges for a Category, or if one or more of the accepted ten judges in a Category is unable to or does not fulfill the judging requirements, the number of judges in a Category may be reduced to no less than three.
PHASE 2 VOTING: On or about March 5, 2007, the top ten Entries in each Category (as determined by the judges) will be posted on the site. Participants will be invited to vote for their favorite Entry in each Category. Voting will close at 11:59 p.m. E.S.T. on March 12, 2007. In the event of a tie in a Category, the tie will be broken by a panel of one to three judges selected by the Sponsor (these will be judges who evaluated Entries in a different Category in Phase 1). To break the tie, judges will use the same criteria used during Phase 1 to evaluate the tying Entries.
JUDGES MAY VOLUNTEER AS FOLLOWS: Up to ten judges for each Category of the Contest will be selected from among Participants who volunteer to become judges. To judge, you must be an expert in the fast lane lifestyle. To volunteer, 1) you must feel you are living in the fast lane, and 2) you must agree to review the entries in the Category you are judging according to the criteria set forth in the rules and complete your judging and submit your scores to the Sponsor by March 2, 2007, and 3) you may not volunteer to judge a Category in which you already have or will in the future submit an Entry if there are three or less judges in the Category (you may enter if there are more than three judges, and you may not score your own submission). To volunteer, go to the “Volunteer to Judge” page on the site. Complete and submit the form. Thirty judges will be accepted and notified by the Sponsor. Once thirty judges have been accepted, no more judging positions will be available, and we will post a notice on the site that we cannot accept more volunteers. Judges will be selected on a first come-first served basis, along with the Sponsor’s determination as to each volunteer’s ability and commitment to do the job for which she has volunteered. In the event that we do not get at least three volunteers for each Category of the Contest, the Sponsor will arrange for a panel of at least three judges who are experts in the fast lane lifestyle for each Category. The decision of the Sponsor in this regard is final.
7. CONTEST ENTRY REQUIREMENTS: All Entries must meet the following requirements and specifications to be eligible:
(a)The Entry must be the Participant’s original, unpublished, and sole work and must not infringe the copyright, trademark, privacy, publicity, other intellectual property or other rights of any person or entity.
(b)The Entry must meet all specifications set forth by the Sponsor on the Event Site, including length and format.
(c)The Entry must contain content that, in the sole discretion of the Sponsor, is consistent with the standards for a PG-13 rating.
(d)The Entry must not, in the sole discretion of the Sponsor, contain any sexually explicit, disparaging, defamatory, libelous, obscene or other inappropriate content.
SPONSOR’S RIGHT TO DISQUALIFY: At any time during the Contest, Sponsor reserves the right in its sole and unfettered discretion to disqualify and remove any Entry that it believes potentially or actually infringes upon the copyrights, or other rights of any third party, is not consistent with the established tone and character of the Contest or otherwise does not meet the Entry Requirements or comply with any other provisions of these Official Rules.
6.PRIZES:
a)First Prize Winner in the Video Contest will win an 18 kt. Gold “Wife in the Fast Lane” charm bracelet from Sonny’s on Fillmore at www.sonnysjewelry.com. Winner will be able to select her own charms and create a bracelet with an approximate retail value of $1,600.
b)First Prize Winner in the Essay Contest will win a pair of gold and platinum earrings from designer Christian Tse at www.Christiantse.com, approximate retail value of $1,600.
c)First Prize Winner in the One-Liner Contest will win a $2,000 gift certificate from Canyon Ranch. May be used for a stay at the Tucson, Arizona or Lenox, MA locations. Will expire one year after issue date; not transferable; may not be used at SpaClub, on products, in the boutique or Ranch store. Cannot be redeemed in whole or part for cash. Subject to space availability. Please mention that you have a gift certificate when you make your reservation, and surrender it on check in. This prize does not include air transportation to Canyon Ranch.
d)Second Prize Winner in each Contest will receive a jewelry ensemble set from designer Elke Koosman at www.intijewels.com with a retail value of $420 (Video Contest prize), $410 (Essay Contest prize), and $160 (One-liner Contest Prize).
e)Third Prize Winner in each Contest will receive a $250 gift certificate for a custom made, hand crafted silk purse from www.thegibsongirl.com.
f)Top ten winners from both the Essay Contest and the One-Liner Contest may participate in a forty-five minute call with Author Karen Quinn to discuss any aspect of writing and selling your own book. The top ten winners from both the Essay Contest and the One-Liner Contest may also participate in a separate forty-five minute call with Trish Todd, editor at Simon & Schuster, to discuss any aspect of writing and selling your own book. The call will be scheduled after March 13, 2007 and announced. If any of the top ten winners are unable to make the call as scheduled, this prize will be forfeited and no additional compensation will be given.
g)Top ten winners from the Video Contest may participate in a forty-five minute call with Screenwriter Tracey Jackson to discuss any aspect of writing, directing, or producing your own film. The call will be scheduled after March 13, 2007 and announced. If any of the top ten winners are unable to make the call as scheduled, this prize will be forfeited and no additional compensation will be given.
h)The first prize winners in the Video, Essay, and One-Liner contest will have a character named after them (or a loved one/friend if permission is given) in the next book Karen Quinn writes.
i.Incentive Prizes – from time to time, during the term of this Contest, Sponsor may offer Participants the opportunity to win prizes by participating in non-chance related games or activities designed to encourage Participants to visit and surf the Contest site (“Incentive Events”).
Prizes consist of only those items specifically listed above as part of the prize. No substitution or transfer of prizes is permitted, except that Sponsor reserves the right to substitute a prize of equal or greater value in the event that an offered prize is unavailable. All federal, state and local taxes on prizes are the sole responsibility of the winners. All prizes are awarded “as is” with no guarantee either express or implied. Use/redemption of all Gift Certificates is subject to issuer’s terms and conditions applicable to such Gift Certificates.
8. GENERAL RULES: All prizewinners will be notified by e-mail at the e-mail address provided on the Event Site during the registration process. If a winner cannot be contacted, or if any prize is returned as undeliverable, or in the event of noncompliance with these Official Rules and requirements, the prize will be forfeited and an alternative winner will be selected. Upon prize forfeiture, no compensation will be given. Winners, as a condition of being awarded any prize, will be required to sign and return any applicable documentation deemed necessary by Sponsor, including, but not limited to, all required clearances and releases set forth in the Terms of Use, an Affidavit of Eligibility confirming that winner accepts and agrees to be bound by and has complied with these Official Rules, a Liability Release, and a Publicity Release, unless prohibited by law. The documents must be returned within seven (7) days following attempted notification. Noncompliance within this time period may result in disqualification and selection of an alternate winner.
By participating in the Contest, Incentive Events and/or accepting any prize, participants grant permission to Sponsor and its advertising and promotion agencies to use their name, likenesses, Entries and any other material submitted in connection with the Event and for purposes of advertising, publicity and promotion purposes, without further compensation to Entrant, unless prohibited by law. Participants agree to be bound by the Official Rules and the decisions of the judges, which are final and binding on all matters relating to the Event. Participants hereby release and hold harmless Sponsor, and its respective affiliates, agencies, employees, officers, directors, shareholders and agents from any and all claims, demands, losses and liabilities arising out of their participation in the Event and/or the use or acceptance of any prize won.
THIS EVENT IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND EXPRESS OR IMPLIED INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT.
9. EVENT PARTICIPATION CONDITIONS: As a condition of participating in the Event, each Participant further agrees as follows:
(a)That during the Event Period, Sponsor and its third-party vendors engaged to implement these Contest are authorized to display the Entries, the voter ratings, comments and reviews (”Comments”) on the Event Site in connection with the Contest.
(b)That Sponsor has access to and/or may create or have created literary, film, tape and/or other materials, ideas and concepts which may be similar or identical to the Entries in theme, idea, plot, format, characters and/or other respects. Participants understand and agree that they will not be entitled to any compensation or other consideration because of the use by Sponsor, of any such similar or identical material, ideas and/or concepts and further understand and agree that Sponsor’s use of material containing elements similar to or identical with those contained in the Entries shall not obligate Sponsor to negotiate with nor entitle Participant to any compensation or other claim.
(c)Sponsor is not responsible for lost, late, illegible, incomplete, invalid, unintelligible, or misdirected entries, which will be disqualified. Only fully completed entry forms are eligible. Proof of submissions will not be deemed to be proof of receipt by Sponsor. All Entries become the sole property of Sponsor and will not be acknowledged or returned. In the event that less than five entries are received in any category, Sponsor reserves the right to cancel that category of the Contest and shall be under no obligation to award the prizes. The Sponsor reserves the right in her absolute discretion to modify the Official Rules and/or cancel, terminate, modify the Contest at any time. In the event of termination or cancellation, winners will be selected from all eligible entries received before the time of termination, or as otherwise deemed fair and appropriate by the Sponsor.
(d)Participant agrees to indemnify and hold harmless Sponsor and their respective affiliates, subsidiaries, licensees and assigns, and their respective officers, directors, employees, agents’ representatives, independent contractors (collectively the Releasees) from and against any and all claims, liabilities (including, but not limited to, attorneys’ fees and disbursements), demands and actions of every kind and nature, whether or not now known or suspected (collectively, “Claims”), arising out of or in connection with (a) any Entry submitted by Participant (including, but not limited to, any and all claims of third parties, whether or not groundless, based on the Entry of such other material and (b) any breach by Entrant of any warranty, agreement or representation contained in the Official Rules or terms of service or in any documentation submitted by Participant. Further, by participating in this Event, each Participant hereby releases the Releasees from any and all liability whatsoever for any claims, costs, injuries, losses or damages of any kind arising out of or in connection with Participant’s participation in the Event or the acceptance or use of any prize.
(e)That the Entry, and any and all material submitted by the Participant in connection with the Event and Entry (the “Material”) shall be subject to and governed by the Official Rules set forth at the Event Site. Without limiting the generality of the foregoing, each Participant agrees that the Material shall become the sole and exclusive property of Sponsor, that Sponsor shall own all right, title and interest in and to such Material and that Sponsor shall have the right, throughout the world and in perpetuity to use, publish, edit, adapt, modify, discuss, distribute or otherwise exploit the Material in any manner or media it shall elect, and to copyright the Material in Sponsor’s name, without additional compensation to Participant. In the event Sponsor deems it necessary, Participant agrees to execute such documents as may be requested by Sponsor to effectuate the intent and purpose of this paragraph and to accomplish evidence and perfect the rights granted to Sponsor pursuant to this paragraph. The documents must be returned within seven (7) days following attempted notification at the e-mail address provided on the Event Site during the registration process. Noncompliance within this time period may result in disqualification and selection of an alternate winner.
10. INTERNET: The Sponsor is not responsible for any electronic transmission errors resulting in any omission, interruption, deletion, defect, delay in operations or transmissions, theft or destruction or unauthorized access to or alterations of any entries/photographs submitted, or for any technical, network, telephone equipment, electronic, computer, hardware or software malfunction or limitations of any kind, or any inaccurate transmissions of or failure to receive entry information on account of technical problems or traffic congestion on the Internet. If for any reason the Internet portion of the Event is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sponsor which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Event, the Sponsor reserves the right in its sole and unfettered discretion to cancel, terminate, modify or suspend the Event and to award any prizes based on entries received prior to termination. THE SPONSOR RESERVES THE RIGHT IN ITS SOLE AND UNFETTERED DISCRETION TO DISQUALIFY ANY PERSON WHO TAMPERS OR IS SUSPECTED OF TAMPERING WITH THE ENTRY AND/OR VOTING PROCESS. CAUTION: ANY ATTEMPT BY PARTICIPANT TO DELIBERATELY DAMAGE ANY WEBSITE, INCLUDING, BUT NOT LIMITED TO, THE EVENTSITE, OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND/OR OTHER RELIEF FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT OF THE LAW.
11. DISPUTES/GOVERNING LAW: Except where prohibited by law, as a condition of participating in this Event, Participant agrees that any and all disputes which cannot be resolved between the parties, claims and causes of action arising out of or connected with this Event, or any prizes awarded, or the determination of winners shall be resolved individually, without resort to any form of the American Arbitration Association, then effective. Further, in any such dispute, under no circumstances will Participant be entitled to seek injunctive relief nor will Participant be permitted to obtain awards for, and hereby waives all rights to claim punitive, incidental or consequential damages, or any other damages, including attorneys’ fees, other than entrant’s actual out-pocket expenses (e.g., costs associated with entering these Contest), and Participant further waives all rights to have damages multiplied or increased. In the event of a dispute as to the identity of a winner based on email address, the winning entry will be declared made by the Authorized Account Holder of the email address submitted at time of entry. For purposes of these Official Rules, “Authorized Account Holder” is defined as the natural person who is assigned to an email addresses by an Internet access provider, online service provider or other organization (e.g., business, educational, institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address.
This Contest is governed by US law and is subject to all applications to the federal, state and local laws and regulations. Void where prohibited by law or where it is determined that state or local requirements for holding a contest may not have been satisfied. All issues and questions rights and obligations of Participant in connection with this Event shall be governed by, and construed in accordance with, the laws of the State of New York, U.S.A., without giving effect to the conflict of laws rules thereof and any matters or proceedings which are not subject to arbitration as set forth in Section 22 of these Official Rules and/or for entering any judgment on an arbitration award, shall take place in the State of New York, in the city of New York, County of New York.
The parties waive rights to trial by jury in any action or proceeding instituted in connection with these Official Rules and/or this Event. Any controversy or claim arising out of or relating to these Official Rules and/or this Event shall be settled by binding arbitration in accordance with the commercial arbitration rules of the American Arbitration Association. Any such controversy or claim shall be arbitrated on an individual basis, and shall not be consolidated in any arbitration with any claim or controversy of any other party. The arbitration shall be conducted in the State of New York, in the city of New York, County of New York, and judgement on the arbitration award may be entered into any court having jurisdiction thereof.
12. USE OF DATA. Sponsor has a spam-free policy. Sponsor will be collecting personal data about participants on-line but will not sell, rent, or share this information with anyone. Data collected will be used to send updates to participant on the contest, future contest, plus periodic communications from Karen Quinn, the Sponsor. If you do not wish to continue receiving communications from the sponsor, you will be able to use the unsubscribe link at the bottom of any email you receive.
